1. Overview

This website, polishpens.com, is operated by Polish Pens ("we", "us", "our"). By visiting our site or purchasing from us you agree to these Terms of Service ("Terms"), including the policies linked here. If you do not agree, please don't use the site. Our store is hosted on Shopify, which provides the e-commerce platform and checkout.

2. Eligibility and accounts

You must be at least the age of majority where you live, or have the consent of a parent or guardian, to purchase. You agree to give accurate, current and complete information at checkout, including your name, email, phone number and shipping address.

3. Products and descriptions

We try to show our products, colors and contents as accurately as possible. Colors may look slightly different on different screens, and packaging may change. Product images are for illustration. We may limit quantities, refuse or cancel any order, or discontinue any product at any time.

4. Pricing and payment

Prices are shown in the currency selected at checkout and may change without notice. Bundle and sale discounts apply only during the stated period. If an item is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Payment is processed securely at checkout; we do not store your full card details.

5. Order confirmation and fraud prevention

Your order is an offer to buy. We accept it when we ship it. We may verify orders, and may cancel orders that appear fraudulent or that fail verification, with a full refund.

6. Shipping and delivery

Shipping times, costs and responsibilities are described in our Shipping Policy, which forms part of these Terms. Title and risk of loss pass to you when the carrier records the parcel as delivered to the address you provided.

7. All sales final

All sales are final. Our Return & Refund Policy, which forms part of these Terms, explains the exceptions for items that arrive damaged, defective, incorrect or are lost in transit, and how to make a claim. You agree to this policy when you place an order.

8. Order records and dispute resolution

To protect both you and us, we keep records of every order, including the order confirmation, the IP address and device used, the shipping address entered at checkout, your acceptance of these Terms, carrier tracking and delivery confirmation, and all customer service messages.

If you have a problem with an order, you agree to contact us first through our Contact page and give us a reasonable chance (at least 7 days) to resolve it before opening a dispute or chargeback with your bank or card issuer. If a dispute or chargeback is filed, we will provide these records, including these Terms and your acceptance of them, to the payment processor and card issuer as evidence. Filing a chargeback for an order that was delivered as described, or while a claim with us is open, may be treated as a breach of these Terms, and we may refuse future orders from that account.

9. Product use and safety

Use products only as described and follow any safety warnings and age guidance on the packaging and product page. Adult supervision is recommended for children. We are not responsible for damage or injury caused by misuse.

10. Intellectual property

All content on this site, including text, graphics, logos and images, belongs to Polish Pens or its licensors and may not be copied or reused without permission.

11. Reviews and comments

If you submit a review or comment, you confirm it is honest and based on your own experience, and you allow us to display it on our site and marketing.

12. Third-party links and services

Our site may link to third-party sites or use third-party services (such as payment processors and carriers). We are not responsible for their content or practices.

13. Disclaimer and limitation of liability

To the fullest extent allowed by law, products and this site are provided "as is" without warranties of any kind beyond those required by law. Our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms excludes liability that cannot be excluded by law.

14. Your statutory rights

Nothing in these Terms affects rights you have under the consumer protection laws of your country that cannot be waived, including any withdrawal or cancellation rights in the EU or UK.

15. Privacy

How we collect and use your information is described in our Privacy Policy.

16. Changes

We may update these Terms at any time by posting the new version on this page. The version in place when you placed your order applies to that order.

17. Governing law

These Terms are governed by the laws of the United States and the state in which Polish Pens is based, except where the law of your country of residence requires otherwise.
